We represent women and men with a wide range of legal needs in the area of matrimonial and family law. The level of complexity and conflict varies for each client, but we will resolve disputes by way of negotiation or litigation. Either way, our clients can expect a legal strategy customized to their unique financial, emotional and legal needs.

At FINUCANE HARTZELL, we are prepared to assist clients with matrimonial and family law issues including the following:

Asset Distribution

High-asset divorces can be complicated because of the nature of the property accumulated by the couple during marriage. A high-asset divorce may also include the division of retirement funds, stock options, pensions, and other assets for which the value is not immediately apparent. Similarly, intellectual property or multiple homes and vacation properties may need to be valued. In addition, couples that own a family business, medical practice, or law practice may have different senses of what these businesses are worth. Our attorneys have a network of professionals with whom they have worked, that enables them to garner the resources necessary for a successful outcome. Each client is provided with all necessary team members that may be required for fully informed decision making. Those team members may contribute to financial analysis and to the resolution of more personal family interests. As a result, the legal advice the client receives is tailored to that particular person’s needs.

Child Custody

Our lawyers have a history of assisting clients bringing and defending custody issues. We understand how to manage client concerns effectively and efficiently. We work closely with clients to tailor parenting plans to the specific situation faced. Doing so may necessitate the involvement of health care professionals, such as pediatricians, psychiatrists and psychologists. We are able to provide the necessary services often inherent in the emotion-packed resolution of conflict surrounding children’s issues.

Child Support

Both parents are financially obligated to support a child. The court will typically order child support in accordance with the NYS Child Support Standards Act and calculate support based on a parent's monthly income, with certain deductions. The child support order may last until the child is emancipated. If you are concerned about the amount of child support you need to receive or are being ordered to pay, you should consult one of our attorneys.

Modifications

After a divorce, the parties’ situations may change significantly. Sometimes a judgment of divorce or child custody arrangement should be modified. For example, custody or visitation can be changed if there is a significant change of circumstances that affects the child’s interests. If you are requesting a change, we recommend meeting with one of our attorneys to discuss obtaining a modification before the situation becomes such that you cannot comply with the court order.

Enforcement of Court Orders

Often, it becomes necessary after a divorce to enforce court orders related to child custody, child support, maintenance or property distribution. An enforcement proceeding should be brought with the help of an experienced attorney.
